Abstract
Desde la promulgación de la Constitución de 1991 en Colombia, la respuesta estatal al problema de la mora judicial ha sido un desafío constante. A pesar de los esfuerzos legislativos y la creación de instituciones, No obstante, la congestión en los tribunales, juzgados de todas las jerarquías persiste. La separación de poderes y la autonomía judicial dificultan la implementación de reformas eficaces. Como es el caso de penales, administrativo, laborales y civiles, cada uno tiene sus propias exigencias. En ese orden de ideas a lo largo de las décadas, se han propuesto diversas iniciativas para agilizar los procesos judiciales y reducir la acumulación de casos, pero la efectividad de estas medidas sigue siendo limitada. La complejidad del problema requiere un enfoque integral que aborde no solo aspectos legislativos sino también estructurales y de gestión.
Since the promulgation of the 1991 Constitution in Colombia, the state response to the problem of judicial delays has been a constant challenge. Despite legislative efforts and the creation of institutions, congestion persists in the courts, courts of all hierarchies. The separation of powers and judicial autonomy makes it difficult to implement effective reforms. As is the case with criminal, administrative, labor and civil, each one has its own requirements. In this vein, over the decades, various initiatives have been proposed to streamline judicial processes and reduce the backlog of cases, but the effectiveness of these measures remains limited. The complexity of the problem requires a comprehensive approach that addresses not only legislative but also structural and management aspects.
