Evaluación de la gestión de las juntas administradoras locales ante el municipio de Popayán. 2020 - 2022

Abstract

El presente trabajo evalúa la gestión, que de manera altruista realizan unos servidores públicos, los cuales integran las Juntas Administradoras Locales JAL, en el municipio de Popayán, departamento del Cauca. Teniendo en cuenta las condiciones en que desempeñan sus funciones constitucionales y el poco apoyo que reciben de la administración municipal. Para lo cual fue necesaria una caracterización de las diferentes JAL que integran las comunas del municipio, mediante la aplicación de una encuesta en la que participaron 31 ediles de los 53 que integran las nueve (9) JAL que en estos momentos tiene la ciudad. También se llevó a cabo una revisión documental, tanto de investigaciones que han antecedido a la presente, como de normas que ayuden a orientar el desarrollo del objeto de la presente investigación. En la revisión documental se consultó desde la historia de las JAL, los aspectos legales, las facultades que tienen, las limitaciones en el marco normativo. En la consulta se pudo evidenciar que hasta el momento en la ciudad de Popayán no se ha efectuado un estudio relacionado con las JAL a pesar de que esta corporación lleva más de sesenta años de tener reconocimiento jurídico y treinta años de reconocimiento constitucional. Además, se realizó una observación participante con el objeto de analizar cómo se realiza la gestión de los Ediles, en las diferentes comunas del municipio de Popayán, su relación tanto con la comunidad como con la administración local. Se concluye en que hay necesidad de una intervención en esta corporación pública y más cuando está en curso la reglamentación de la ley 2086 del 2021 donde se les reconoce unos incentivos por la gestión realizada.

This paper evaluates the altruistic management of public servants who are members of the Local Administrative Boards (JAL) in the municipality of Popayán, department of Cauca. Taking into account the conditions in which they perform their constitutional functions and the little support they receive from the municipal administration. For which it was necessary a characterization of the different JAL that integrate the communes of the municipality, by means of the application of a survey in which 31 councilmen of the 53 that integrate the nine (9) JAL that at the moment have the city participated. A documentary review was also carried out, both of investigations that have preceded the present one, as well as of norms that help to guide the development of the object of the present investigation. In the documentary review, the history of the JALs, the legal aspects, the powers they have, and the limitations in the regulatory framework were consulted. In the consultation it became evident that so far in the city of Popayan there has not been a study related to the JAL despite the fact that this corporation has been legally recognized for more than sixty years and has been constitutionally recognized for thirty years. In addition, a participant observation was carried out with the purpose of analyzing how the management of the councilors is carried out in the different communes of the municipality of Popayán, their relationship both with the community and with the local administration. It is concluded that there is a need for an intervention in this public corporation, especially when the regulation of law 2086 of 2021 is in progress, which recognizes incentives for the management performed.
